The agreement governing your use of Keystone Web Design services.
By accessing our website at keystonedesign.dev or engaging Keystone Web Design ("Company," "we," "us," or "our") for web design, development, or hosting services, you ("Client" or "you") agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not use our services.
We reserve the right to update or change these Terms at any time. Your continued use of our services following any changes constitutes acceptance of the revised Terms.
Keystone Web Design provides web design, web development, website hosting, and related digital services to small and local businesses. Specific deliverables, timelines, and pricing for each engagement will be outlined in a separate project agreement or invoice provided at the time of engagement.
Our demo-first model means we may research your business and build a demonstration website prior to any payment. By engaging our services or requesting a demo, you grant us permission to research your publicly available business information for this purpose.
Payment terms will be specified in the project agreement or invoice. Unless otherwise agreed in writing:
Each plan includes a specified number of revision requests per month as part of ongoing maintenance. Revisions are defined as content updates, minor layout adjustments, or other reasonable change requests submitted in writing. Revisions do not include full redesigns, new page builds, or functionality additions, which may be quoted separately.
Unused revisions do not roll over to the following month. Revision counts reset on the first of each calendar month.

Upon receipt of full payment, you will own the content and design elements of your website that were created specifically for your project. We retain ownership of any proprietary tools, frameworks, templates, or code libraries used in the development of your site that are not unique to your project.
We reserve the right to display your completed website in our portfolio and use it for promotional purposes unless you request otherwise in writing prior to launch.
We strive to maintain reasonable uptime for all hosted websites but do not guarantee uninterrupted service. Planned maintenance, third-party provider outages, or circumstances beyond our control may result in temporary downtime. We will make reasonable efforts to minimize disruption and communicate planned maintenance in advance.
We are not liable for data loss, though we maintain regular backups as part of our hosting infrastructure.
Either party may cancel ongoing hosting services with 30 days' written notice. Upon cancellation, we will provide you with your website files in a standard format upon request. You are responsible for arranging alternative hosting after the cancellation date.
We reserve the right to terminate services immediately if a client violates these Terms, engages in abusive behavior toward our staff, or fails to pay outstanding invoices after reasonable notice.
To the fullest extent permitted by law, Keystone Web Design shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, or loss of data, arising out of or related to your use of our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the total amount paid by you to us in the three months preceding the claim.
Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will meet all of your requirements or that they will be error-free.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Tuolumne County, California.
